Re-Examination Alert

An important change in patent law associated with the America Invents Act became effective September 16, 2012.  The cost of an ex-parte re-examination of an issued U.S. patent, a procedure which provides a non-judicial review of patent validity, increased from approximately $2,500 to over $17,000 or more depending on the number of claims.  Similarly, the cost of an inter partes re-examination rose from approximately $9,000 to over $27,000 dollars or more.  Please contact your Boyle Fredrickson attorney if you have any questions.
